1. Provider, contacts, and scope
MyRoam is a personal travel diary. The service provider is Germano Spina, an individual established in Italy, with professional/legal address at Via Emanuele Cutore 64, 95030 Gravina di Catania (CT), Italy.
Official contacts: support@myroam.app for support; legal@myroam.app for legal and intellectual-property matters; privacy@myroam.app for privacy requests; and myroam.app.
These Terms govern consumers’ use of MyRoam. The service is not offered as a professional or business service and is not intended for professional or commercial use. The relationship between these Terms and the Privacy Notice is described in section 3.
2. Definitions
- MyRoam, Service, or Provider means the personal diary and service operated by Germano Spina.
- Account means the MyRoam account linked to an authenticated identity.
- User Content means data entered by the user, including trips, stops, experiences, transport, accommodation, notes, costs, places, coordinates, and uploaded photographs.
- Public Link means a sharing link available to anyone who obtains it, without MyRoam authentication.
- Saved Trip means a link or saved reference to another user’s shared trip, not an independent copy.
- Imported Copy means a structured, editable copy created by the receiving user when sharing permits import.
- Document Version means the exact version and language of the legal document presented by the Service.
3. Service and legal documents
MyRoam lets users register and authenticate, manage an Account and profile, create personal trips, organize experiences, transport, accommodation, notes, costs, places, and coordinates, add photographs and galleries, create Public Links, save trips, import independent copies, export data, delete an Account, and view and accept legal documents.
MyRoam is an informational tool for keeping travel memories and information. It does not provide bookings, tickets, accommodation, brokerage, agency or tour-operator services, professional travel advice, or guarantees about destination safety or suitability.
The Privacy Notice explains personal-data processing. It is separate from these Terms: its presentation is not contractual acceptance and is not turned into general consent by accepting these Terms. Its document action is PRESENTED, while acceptance of these Terms is ACCEPTED.
4. Service availability and technical limits
MyRoam is currently available to the public free of charge. The Provider may apply reasonable technical limits to the free service, including storage and upload limits, shown in the app where relevant. Those limits may change according to the needs of the Service and are not a promise of permanently fixed capacity.
Paid features may be introduced in the future under updated terms and documents, if needed. Subscription Terms are not part of the current contract and do not apply unless paid features are publicly offered.
5. Access requirements and registration information
The Service is intended for people aged 16 or older. The user must provide true, current, and complete information and correct it when it changes.
Future paid features or purchases may have additional requirements communicated before availability. Those requirements are not general parental consent to create an Account or process personal data.
6. Registration, contract formation, and access
Registration may use email and password, a telephone number with OTP verification, or Google/Firebase, according to available options. The general contract for the Account and Service is formed when registration is completed with acceptance of the Terms Document Version and recording of the legal events required by the Service.
The local Account, the ACCEPTED event for these Terms, and the PRESENTED event for the Privacy Notice must be completed in the same Service operation. If local Account creation or persistence of a required legal event fails, registration is not completed and the contract is not formed.
Email registration requires address verification for full access to protected features. Telephone registration requires successful OTP verification. Google registration requires successful Firebase authentication and linking the identity to the local Account.
The user must protect passwords, codes, devices, and other access tools, must not share them, and must promptly report unauthorized access. The user is responsible for activity through the Account unless reasonable security measures were taken and abuse was reported without delay.
Acceptances are tied to the exact version, language, and content of the document. If a later version replaces an earlier one, MyRoam will present it. New acceptance will be requested only for material changes or where required by law. If the user refuses such a change, MyRoam may limit operational features while keeping legal documents, export, Account deletion, logout, and support contact available where technically possible.
7. User Content and responsibility
The user retains ownership and other rights in User Content and represents that they have the rights, permissions, and lawful basis needed to enter, store, and share it, including photographs of other people, personal data, and third-party information.
The user is responsible for uploaded and shared content and should avoid unnecessary data, especially other people’s sensitive data without valid authorization. The Provider does not acquire ownership and may not use content for advertising, AI training, sale, unrelated analysis, or unrelated commercial reuse.
8. Limited technical licence
For only the time and extent necessary to provide MyRoam, the user grants the Provider a non-exclusive, worldwide licence limited to User Content to receive, host, store, technically process, compress, resize, convert (including to WebP), generate thumbnails, display it privately, transmit selected parts through a user-activated Public Link, transmit it to a recipient, create an Imported Copy when authorized and requested, delete it, and perform necessary technical cleanup.
Infrastructure providers may process content only as needed for these operations. The licence lasts while content remains in the Service and for the technical time needed for deletion and cleanup. It does not include transfer of ownership, advertising, AI training, sale, commercial profiling, or unrelated uses.
9. Public Links, Saved Trips, and Imported Copies
A Public Link is a bearer link: anyone who has it can view the public part of a trip without a MyRoam Account. The user chooses what to share. The link may expire, including by a default 24-hour expiry where applicable, or remain valid until manual revocation. The user may revoke it.
Non-indexing and non-caching settings do not guarantee that a known link will not be copied, forwarded, photographed, downloaded, or viewed by third parties. The user must verify rights and permissions concerning people, photographs, places, and information in public content.
A Saved Trip remains linked to the available sharing and is not a backup or independent copy. An Imported Copy belongs to the importing user as a separate, editable copy. It may remain available if the original author deletes the Account or stops sharing. Import does not transfer ownership of the author’s original content.
Management of a Public Link remains with its author, who may revoke it according to available options. MyRoam does not promise administrative revocation or moderation of Public Links, and this is not a promise of general monitoring.
10. Prohibited uses
The user must not use MyRoam for unlawful, violent, discriminatory, or pornographic content or uses; impersonation or fraud; privacy or personal-data violations; infringement of copyright, trademarks, image rights, or other intellectual-property rights; unauthorized scraping, bots, crawlers, automated access, APIs, or endpoints; evasion of access controls, limits, or quotas; or abuse of the Service, platform, infrastructure, Public Links, or other users.
MyRoam does not promise general proactive monitoring. It may act on user reports, security signals, abuse indicators, and legal communications or orders. The user must cooperate with reasonable checks and must not obstruct Service security or operation.
11. Restrictions, suspension, and termination
The Provider may limit or suspend access or terminate the contract for a material or repeated breach, unlawful use or content, a security or safety risk, abuse of the Service or platform, or when needed to preserve Service integrity.
For non-urgent breaches, the Provider will normally explain the reason and give a reasonable opportunity to remedy it. For an urgent risk, it may act immediately and will explain the reason and review options as soon as reasonably possible, subject to law, investigations, security, and abuse prevention.
The user may request review at support@myroam.app. During a restriction, support, export, deletion, and logout remain available where technically possible. An Account will not be suspended or deleted merely because it is inactive. The user may end the relationship at any time by requesting Account deletion.
12. Availability, maintenance, and Service changes
MyRoam is provided with reasonable availability on a best-efforts basis. It is not guaranteed to be always available, error-free, or uninterrupted, and no availability SLA is offered.
The Provider will communicate planned maintenance where reasonably possible and prolonged or materially impactful incidents where practicable. The Service may depend on Firebase, Google, hosting, databases, object storage, email, place-search services, and other third-party infrastructure. An interruption solely attributable to those dependencies may affect availability within the limits of law.
A change is material if it significantly affects essential functions, user rights, the processing or management of User Content, access to the Service, or the conditions of other services that may be offered. For a material change, the Provider will normally give at least 30 days’ notice through the app and, where available, email. Notice may be shorter where required by law, an authority, security, abuse prevention, or binding platform rules.
New acceptance will be requested only for material or legally necessary changes. If the Service is closed, the Provider will normally give at least 30 days’ notice and, where reasonable and technically available, at least 30 days to export data.
13. Export, deletion, and technical retention
The user may export data through available features and request Account deletion from settings or support. Deletion starts operational removal of Account and linked local data and may remain temporarily pending while necessary technical deletion is completed.
Backups, technical copies, logs, and provider copies follow applicable overwrite and retention cycles; instant deletion from every backup is not guaranteed. Only the minimum data needed for legal obligations, security, fraud prevention, dispute management, or technical cleanup may be retained. No unverified numeric periods are stated.
Deleting the source Account does not automatically delete Imported Copies belonging to other users. Public Links, downloaded copies, screenshots, and other content already transmitted may also be beyond the Provider’s ability to recover or delete.
14. Places and travel information
Place names, coordinates, destination images, and information supplied by third-party services may be incomplete, outdated, or inaccurate. Results may depend on external services. MyRoam does not check every item and does not provide professional travel advice, emergency guidance, or bookings.
The user remains responsible for travel decisions, safety checks, entry requirements, local conditions, and checking current official information.
15. MyRoam intellectual property
Software, interfaces, trademarks, graphics, text, and Service components that are not User Content belong to the Provider or their respective owners. The Provider grants the user a personal, non-exclusive, non-transferable right to use MyRoam for a personal diary during the relationship.
Unless permitted by law or authorized in writing, the user must not copy, distribute, sell, license, reverse engineer, alter, or commercially exploit the Service or its components. This does not limit the user’s rights in User Content or third-party rights.
16. Support, complaints, and intellectual-property reports
The Provider offers reasonable support through support@myroam.app, without guaranteeing a maximum response time. An unresolved legal complaint may be sent to legal@myroam.app.
An intellectual-property report should identify the right relied on, the link or identifier of the content, supporting evidence, the reporter’s identity and contact details, and a good-faith statement. The Provider may temporarily limit access or remove content during review and, where appropriate, inform the affected user and offer an opportunity to respond.
17. Liability and mandatory rights
The Provider is responsible, within applicable law, for foreseeable direct losses attributable to a breach of its obligations. Indirect or unforeseeable losses, including lost opportunities or profits, are excluded only to the extent permitted by law.
The Provider takes reasonable measures to protect data but does not guarantee the complete absence of loss, damage, or unavailability. The user should keep copies of important content. The Provider is not responsible, to the extent permitted, for interruptions caused exclusively by third parties where responsibility is not attributable to the Provider.
The user remains responsible for uploaded or shared content and necessary rights and permissions. Nothing excludes liability for intent, gross negligence, personal injury, or other cases where exclusion is prohibited. Nothing limits mandatory consumer rights concerning conformity, supply, and remedies for digital services under applicable consumer and European Union law.
18. Changes to the Terms and document access
This is Version 1.0.0 of these Terms. The version and effective date are shown in the app and in the document presented to the user.
Changes follow section 12. Presented versions and related actions may be retained as technical evidence to the extent described in the Privacy Notice. Acceptance of these Terms does not replace presentation of the Privacy Notice and is not general consent to process data.
19. Applicable law, complaints, and disputes
These Terms are governed by Italian law, without prejudice to mandatory rules and consumer protections under the law of the country where the consumer habitually resides.
Before using an external body, the consumer may complain to support@myroam.app and, if unresolved, to legal@myroam.app. Applicable ADR mechanisms and competent bodies remain available.
For cross-border disputes, mandatory rules on the consumer’s competent court apply. This clause does not prevent the consumer from applying to a court competent under those rules. The Italian version is the proposed reference language only to the extent compatible with mandatory consumer rights and applicable translation rules.
20. Final provisions
If a provision is invalid or unenforceable, it will be replaced or interpreted only as necessary to make it valid without affecting mandatory consumer rights; the remaining provisions remain effective. Failure to exercise a right is not a waiver.
